An arraignment is a defendant’s first appearance before a judge after an arrest. In Manhattan it usually happens within 24 hours at 100 Centre Street, and it often lasts only a few minutes. Those minutes still matter, because the judge decides whether you go home.
Here is what to expect, and how a lawyer can help.
Before you see the judge
After an arrest you are fingerprinted and held while the District Attorney’s office prepares the complaint. You meet your lawyer briefly before the case is called. This is the time to share the information that supports release: where you live and work, your family ties and any caring responsibilities.
In the courtroom
The judge reads or summarises the charges, and your lawyer enters a plea of not guilty on your behalf. Do not discuss the facts of the case in court. Sometimes the prosecution makes an offer at arraignment. Never accept a plea without understanding how it affects your record, your job and, where relevant, your immigration status.
Release and bail
For most misdemeanours and many non-violent felonies, New York law requires release without bail. For other charges the judge may set bail or conditions such as supervised release. Your lawyer argues for the least restrictive option, using what you shared before the hearing.
Orders of protection
Where there is a complainant, the judge may issue a temporary order of protection. It can require you to stay away from a person or a home, even your own. Follow it exactly, even if the other person contacts you. A breach is a separate crime.
After the arraignment
The judge sets the next court date. In felony cases where you are held, the prosecution must present the case to a grand jury within strict time limits. Use the time to gather documents, discuss the case only with your lawyer and stay off social media about it.
Getting a lawyer there
Families can call us at any hour on +1 (212) 555-0148. A partner or associate attends arraignment the same day, so the first decision in your case is made with someone on your side.
