Outcome
Charges dismissed before trial
Our client was charged with securities fraud on the word of a single cooperating witness. We exposed gaps in the trading records at the suppression hearing and the prosecution withdrew every count.
01
The challenge
Our client, a mid-level portfolio manager, was indicted on four counts of securities fraud. The case rested almost entirely on a former colleague who had agreed to cooperate after his own arrest and who said our client had traded on information passed to him over dinner.
The government also relied on statements our client gave to agents at his home, without a lawyer, on the morning of the search. A conviction would have meant a prison sentence and the end of his career.

02
Our approach
We tested the witness against the records, and the statements against the law.
01. Rebuild the trading timeline
Adaeze Okafor reconstructed every relevant trade from exchange data. Two of the trades the witness described had been placed before the dinner he said prompted them.
02. Challenge the statements
We moved to suppress the home statements on the ground that our client was in custody in all but name and had not been properly advised of his rights.
03. Use the hearing
At the suppression hearing we cross-examined the case agent on the timeline, putting the inconsistencies on the record before trial.
“Marcus never once told me it would be fine. He told me exactly what they had, and then he took it apart.”

03
The outcome
The court suppressed the bulk of the home statements. Three weeks later, faced with a cooperating witness the records contradicted, the government moved to dismiss every count. Our client entered no plea and returned to work.
